NOTICE TO BIDDERS

BOROUGH OF MADISON, MORRIS COUNTY, NEW JERSEY

CO-LOCATION BY WIRELESS TELEPHONE CARRIERS AT THE KINGS ROAD COMMUNICATIONS FACILITY

NOTICE IS HEREBY GIVEN that sealed bids will be received by the Borough of Madison, County of Morris, State of New Jersey, in the Board Room, 2nd Floor, Hartley Dodge Memorial, 50 Kings Road, Madison, New Jersey on MONDAY, NOVEMBER 15, 2004 AT 10:00 AM, prevailing time, and at that time publicly opened and read for CO-LOCATION BY WIRELESS TELEPHONE CARRIERS AT THE KINGS ROAD COMMUNICATIONS FACILITY. Bid prices shall remain firm for a period of sixty (60) days.

Bids shall be addressed to the Borough Clerk, Borough of Madison, Hartley Dodge Memorial Building, 50 Kings Road, Madison, New Jersey 07940. Each Proposal must be enclosed in a SEALED ENVELOPE, properly endorsed with the name of the Bidder, with the designation "BOROUGH OF MADISON, SEALED BID, CO-LOCATION BY WIRELESS TELEPHONE CARRIERS AT THE KINGS ROAD COMMUNICATIONS FACILITY, NOVEMBER 15, 2004, 10:00 AM". Any envelope that is received that is not properly marked causing it to be opened prior to the bid opening will be invalidated. Bids may be received before the hour designated in this office, if they are mailed or hand delivered in person. The Borough of Madison will not be responsible for any bid that is sent by mail or other form of carrier which is lost or which arrives after the advertised bid date and time.

Attendance is required at a mandatory pre-bid conference on Thursday, October 28, 2004 at 10:00 am in the 2nd Floor Board Room in the Hartley Dodge Memorial Building, 50 Kings Road, Madison, NJ 07940.

The project includes, generally, but is not limited to:

1. Co-location on the existing 120 FT Monopole Tower.

2. Installation of one unit of the Modular Support Building for Bidder’s Equipment.

3. Shared costs with the Lead Carrier for installation of the facility.

Sealed Proposals must be accompanied by: (1) a duly executed Bid Proposal Guarantee in the form set forth in the Bid Package; (2) a certified check, cashier's check or bid bond payable to the Borough of Madison in an amount equal to 10% of the bid (based upon the highest total bid, if alternative bids are involved), but not to exceed $20,000, and (3) a duly executed Certificate of Surety and Power of Attorney on the standard New Jersey Statutory bond form, as set forth in the Bid Specifications, issued by a surety company licensed to do business in the State of New Jersey and listed in the most recent Federal Register (Circular 570).

In addition to the Proposal, each bidder may be required to submit a statement of his qualifications, experience, financial ability, equipment and a non-collusion affidavit. Failure to submit same with the proposal may result in rejection of the bid. All bids must be submitted on the Proposal Form furnished by the Borough. Bids on any other forms will not be accepted. Bid documents and specifications are available at the Borough Clerk’s office in the Hartley Dodge Memorial, Madison, NJ, from 8:00 AM to 4:30 PM, Monday – Friday.

The Borough of Madison reserves the right to reject any or all Bids, and to waive any informalities therein, and to accept any bid that will be in the best interest of the Borough of Madison, according to N.J.S.A. 40A:11-1 et seq.

Proposals for this contract will be accepted only from bidders who have been properly qualified in accordance with the requirements of the Specifications.

The Borough of Madison reserves the right to delete sections of work from the contract after the award of the bid has been made due to funding or other reasons. The prices bid for various items of work shall not be adjusted due to the deletion of any work due to the variation of any quantity for the various items scheduled in the Proposals.

Bidders are required to comply with the requirements of P.L. 1975, C. 127 (NJAC 17:27 et seq.) (Affirmative Action).
